Obligations
Transparency obligation
Inform persons they interact with AI or view AI-generated content.
Definition
Requires clear disclosure when people encounter AI-generated or manipulated content that could be mistaken for authentic. It also covers telling people when they are interacting with an AI system such as a chatbot, and when they are exposed to emotion recognition. In practice: a visible text label on the product photo (e.g. AI-generated image) — not hidden metadata or a footer-only disclaimer.
What this means for your store
Disclosure has to reach the shopper at first exposure, in clear language, and remain understandable on mobile. That is exactly what EU AI Label puts on the photo.
