Risk levels

Limited risk AI system

Transparency obligations without being high-risk — typical for AI product photos.

Art. 50

Definition

Limited risk describes AI uses that are not prohibited and not high-risk, but that could mislead people if left undisclosed. For these, Article 50 imposes transparency duties instead of the full conformity regime. AI-generated and AI-altered product imagery is the classic limited-risk case for online retail.

What this means for your store

Limited risk still means real work: a visible, understandable label where shoppers first see the image. It does not mean CE marking or conformity assessment.
