Definition
An emotion recognition system infers emotions or intentions of natural persons on the basis of their biometric data. Its use in the workplace and in education is prohibited, and where it is otherwise allowed, Article 50 requires that the people exposed to it are informed. It is one of the few Article 50 duties that sits next to the AI content marking rule.
What this means for your store
If a tool ever analysed shopper reactions to your imagery, disclosure would be required. Labelling AI product photos, by contrast, is a content marking duty under the same article.
