Terms of Service

Last updated: 8 July 2026. Please read these terms carefully before using EU AI Label.

Service provider

EU AI Label ("the Service", "we", "us") is operated by Damian Klimarczyk MDGA, a sole proprietorship registered in Poland.

1. Acceptance of terms

By installing, accessing, or using EU AI Label (including the Shopify app, the WordPress plugin, our website, or any related APIs), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of the Service

EU AI Label is a software workflow tool that helps merchants add visible labels to AI-generated or AI-altered product photos on their online storefronts, and prepare transparency workflows aligned with EU AI Act (Regulation (EU) 2024/1689, Article 50) obligations.

The Service does not constitute legal advice and does not guarantee legal or regulatory compliance. Merchants remain solely responsible for determining their own obligations under applicable law.

3. Eligibility and accounts

  • You must be at least 18 years old and legally able to enter into a contract.
  • You must have an active Shopify store, WordPress site, or equivalent supported platform on which you intend to install the Service.
  • You are responsible for maintaining the security of any credentials associated with your account and for all activity that occurs under your account.

4. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms;
  • Reverse engineer, decompile, or attempt to derive the source code of the Service, except for portions we have explicitly released as open source;
  • Interfere with, disrupt, or impose an unreasonable load on the Service;
  • Use the Service to knowingly misrepresent whether content was generated or modified by AI;
  • Resell or sublicense the Service without our written consent.

5. Plans, billing, and refunds

  • Paid plans are billed through Shopify Billing or the applicable app marketplace, subject to their own terms.
  • Plan limits are based on the number of actively labeled product photos, as described on our pricing page.
  • Subscriptions renew automatically unless cancelled. You may cancel at any time by uninstalling the app; cancellation takes effect at the end of the current billing period.
  • Fees already paid are non-refundable, except where required by applicable consumer-protection law (e.g. the EU Consumer Rights Directive for eligible purchases within the withdrawal period).

6. Intellectual property

The Service, including its software, design, and content, is owned by Damian Klimarczyk MDGA and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. Portions of the Service that we release as open source (for example, the WordPress plugin) are governed by their respective open-source licenses published on our GitHub organisation.

You retain all rights to the product images and content that you upload or label through the Service. You grant us a limited license to process that content solely to operate the Service on your behalf.

7. Third-party services

The Service integrates with third-party platforms such as Shopify, WordPress, and analytics or hosting providers described in our Privacy Policy. We are not responsible for the availability, terms, or content of any third-party service. Your use of those services is governed by their own terms.

8. Warranty disclaimer

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, error-free, or will achieve any specific compliance outcome.

9. Limitation of liability

To the maximum extent permitted by law, in no event shall Damian Klimarczyk MDGA be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability for any claim arising out of these Terms shall not exceed the fees you paid us in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited under applicable consumer-protection law.

10. Termination

You may stop using the Service at any time by uninstalling it from your Shopify admin or WordPress site. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service, in which case we will make reasonable efforts to notify you in advance.

11. Changes to the Terms

We may update these Terms from time to time. Material changes will be announced on this page with a revised "Last updated" date and, where appropriate, in-app. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Poland, without regard to conflict-of-laws principles. The competent courts of Poland shall have exclusive jurisdiction, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.
