# AI-generated vs AI-altered product photos

An AI-generated product photo is created substantially by an AI system. An AI-altered product photo starts from a real photograph but is materially changed with AI — a new background, a swapped model, an added or removed object. For Shopify merchants preparing for the EU AI Act, the distinction matters because it determines which label goes on the product page.

Quick answer

If AI created the scene, label it `AI-generated image`. If AI changed a real photo in a way that materially affects what the shopper sees, label it `AI-altered photo`. When in doubt, label it — under-disclosure is the higher risk.

For Shopify teams, the practical question is almost never _"is this AI?"_ — you know which pipeline made the image. The real question is: _"what should we call this on the product page?"_ Getting the naming right up front saves a rebuild later and avoids ambiguity for shoppers.

## When to use “AI-generated image”

Use this label when the image is substantially the output of a generative model:

- The whole product scene was generated from a prompt.
- The model wearing the product is synthetic (no real person was photographed).
- The environment or background is entirely generated.
- A shopper could reasonably think the scene was photographed but it wasn't.
- The image is a generated render used in place of a photograph.

## When to use “AI-altered photo”

Use this label when you start from a real photograph and use AI to materially change what a shopper sees:

- Background replaced with a generated environment.
- Model's face, body, or outfit swapped or restyled with AI.
- Products, props, or scenery added or removed with AI.
- Lighting, weather, or setting materially transformed.
- Any AI edit that changes what the shopper believes about the product.

## When labeling is generally not required

The Article 50 disclosure obligation targets material AI manipulation, not every AI-assisted step in a production pipeline. In most operational readings, the following do not require an AI label on their own:

- Standard color correction and exposure adjustment.
- Cropping, straightening, and resizing.
- Non-generative noise reduction and sharpening.
- Basic dust and blemish removal on a real product photo.
- Non-generative background isolation (product cut-out on white).

The safer heuristic: **label material AI change, not every edit**. When in doubt, ask legal counsel — see the [Shopify AI Act checklist](/shopify-ai-act-checklist) for the review flow we recommend.

## Real Shopify edge cases

Scenario

Suggested label

Studio-shot product, AI-generated beach background

`AI-altered photo`

Fully generated model wearing your real product photo

`AI-altered photo`

100% generated hero image, no real photo involved

`AI-generated image`

Real photo, AI removed a wrinkle on the fabric

No label needed (minor edit)

Real photo, AI added a second colorway that doesn't exist

`AI-altered photo` — high-risk change

## Set an internal taxonomy — once

The biggest source of inconsistent labeling isn't the law — it's teams making the call image-by-image without a shared rule. Agree on three categories internally:

1. **Photograph** — real photo, no material AI change. No label.
2. **AI-altered** — real photo materially changed with AI. Label as such.
3. **AI-generated** — substantially AI-created. Label as such.

Tag every asset at ingest with one of these three, and the storefront label follows automatically. This is exactly the workflow [How to label AI-generated product images on Shopify](/blog/how-to-label-ai-generated-product-images-shopify) describes end-to-end. See [pricing](/pricing) for plan limits and [partners](/partners) if you work with an agency or theme developer.

EU AI Label supports both AI-generated and AI-altered product-photo labels, with per-photo control and custom wording on paid plans. [Install EU AI Label on Shopify](https://apps.shopify.com/eu-ai-label).

FAQ

## Frequently asked questions

Is background removal considered AI-altered?+

Basic background removal that just isolates the product is usually treated as standard editing. Replacing the background with a generated scene — a beach, a studio, a lifestyle setting — is AI-altered and should be labeled.

Is upscaling or noise reduction AI-altered?+

Not on its own. Upscalers and denoisers use AI, but they don't change what the shopper understands about the product. Label material changes, not every AI-assisted step in your pipeline.

Are AI-generated model shots “generated” or “altered”?+

If the model is fully synthetic, treat the whole image as AI-generated. If you photographed a real model and swapped their face, outfit, or setting with AI, that's AI-altered.

What about virtual try-on or AR previews?+

Virtual try-on shown as a preview to the shopper is generally understood as a simulation. Static product images produced through virtual try-on still count as AI-altered and should be labeled where they appear as product photos.

Can the label text be customized?+

Yes. Paid plans on EU AI Label support custom label text — for example, brand-specific wording or multilingual variants — while enforcing readability and contrast guardrails.

Do product renders (3D CGI) count as AI?+

Traditional CGI/3D rendering is not AI in the Article 50 sense. If you're layering generative AI on top of a render — generated backgrounds, textures, or scenes — that portion should be treated as AI-altered.
